Model and DJ Vogue Williams has brought a claim for alleged breach of contract in the Circuit Civil Court against a Dublin dental clinic.
Her claim is against the Seapoint Clinic Ltd, Seapoint Avenue, Blackrock, Co Dublin, and is listed for trial in court on January 13th.
The clinic has denied it had been in breach of an alleged agreement with her and is making a counter-claim.
Dental treatment
Ms Williams, the estranged wife of singer Brian McFadden, claims that in January 2012 she had an agreement with the clinic for dental treatment which included the replacement of a temporary crown, the fitting of braces and veneers and cosmetic treatment, for an agreed sum just short of €7,000.
The model claims, in documents filed ahead of the hearing of the case, that she had sought to have the treatment carried out for her wedding to Mr McFadden in September 2012.
She claims she had also agreed to do an interview with an Irish newspaper or magazine and a video testimonial promoting the clinic’s website and professional services.
Ms Williams, of Howth Lodge Apartments, Claremont Road, Howth, Co Dublin, alleges that after providing the clinic with the agreed publicity, it had sought full payment for her dental procedures.
Publicity undertakings
She claims that between January and June 2012 she had fulfilled her publicity undertakings and alleges a breach of contract arose when the clinic then sought full payment.
She alleges that in August 2012, a month before the wedding, she rescinded any agreement she had with the clinic. She claims she had been caused upset and worry at a time she was preparing to get married.
Seapoint Clinic, which has delivered a full defence and counter-claim, alleges Ms Williams failed to attend a number of appointments which she had failed to cancel in advance and, as a result, the clinic was put to expense and costs.
The clinic, which claims Ms Williams still owes more than €5,000 for her treatment, alleges it is she who is in “fundamental breach of contract” and is therefore not entitled to succeed in a claim for damages.
It claims the work done by Ms Williams on behalf of the clinic would amount only to the full value of the treatment.
Claims in this court are limited to €38,000.
